What Counts as a Confined Space? (And Why It's So Dangerous)
A confined space is not defined by how cramped it is — it is defined by danger. Under UK law, even a large open-topped tank can qualify. Here is what really counts, and why these spaces kill.
It is not about size — it is about risk
The phrase "confined space" conjures images of cramped tunnels and tiny tanks, but the legal definition has little to do with how roomy a place feels. Under the Confined Spaces Regulations 1997, a confined space is any place that is substantially enclosed and where there is a reasonably foreseeable risk of one or more "specified risks" arising from its enclosed nature. A space can be large and still count; a space can be tight and not count, if the dangerous conditions are absent.
This catches people out. A large storage vessel, an open-topped pit, or a roomy chamber can all be confined spaces in law if the enclosure could lead to a serious specified risk. That is why the test is always the combination of enclosure and foreseeable danger, not square footage.
The specified risks
The regulations list the dangers that make a substantially enclosed space legally "confined". They are:
- Serious injury from fire or explosion — for example flammable vapours or oxygen-enriched atmospheres.
- Loss of consciousness from raised body temperature.
- Loss of consciousness or asphyxiation from gas, fume, vapour or lack of oxygen.
- Drowning from a rise in the level of liquid.
- Asphyxiation from a free-flowing solid such as grain, sand or other loose material, or from being trapped by it.
If a substantially enclosed space could foreseeably give rise to any of these, it is a confined space — regardless of how big or small it looks.
Everyday examples
Confined spaces are far more common than most people assume. They include storage tanks, silos, reaction vessels, sewers, drains and ductwork, enclosed pits, unventilated rooms, and the holds of vessels. Some spaces become confined only during particular work — a normally safe room can turn into one when inerting gas is introduced or when a process generates fumes.
Because the danger can be invisible and odourless, the risk is easy to underestimate. A pit that looked fine yesterday can hold a lethal atmosphere today.

Why the atmosphere is the real danger
Too little oxygen
Oxygen can be displaced by other gases, consumed by rusting metal or biological activity, or removed deliberately during inerting. A worker entering an oxygen-deficient space can collapse within moments, often without any warning sensation.
Too much oxygen, or the wrong gases
An oxygen-enriched atmosphere dramatically increases fire risk. Toxic gases such as hydrogen sulphide or carbon monoxide can poison rapidly, and flammable vapours can turn a routine task into an explosion hazard. The cruel feature of many of these atmospheres is that they give no reliable warning — by the time someone feels unwell, they may already be unable to escape.

When a "safe" space becomes confined
One of the trickiest aspects of the regulations is that a space can change status depending on the work being carried out. A room that is perfectly safe for general occupancy can become a confined space the moment a process introduces a hazard — for example when a flammable solvent is used in a poorly ventilated area, when an inert gas is brought in for purging, or when hot work consumes oxygen and produces fumes. The space itself has not changed shape; the foreseeable risk has appeared.
This is why the assessment must consider the task as well as the place. A storeroom, plant room or partially open structure that nobody would instinctively call "confined" can fall squarely within the definition once you account for what is being done inside it. Judging only by appearance, and not by the work and its by-products, is exactly how people end up entering a space that has quietly turned lethal.
