The law

In England and Wales, fire safety in schools is governed by the Regulatory Reform (Fire Safety) Order 2005, as amended by the Fire Safety Act 2021, alongside the Health and Safety at Work etc. Act 1974. The Order places the duty on the responsible person, and Article 21 requires staff to be given adequate fire safety training. Scotland: Fire (Scotland) Act 2005; Northern Ireland: Fire Safety Regulations (NI) 2010.

What the responsible person must do

  • Take all reasonable measures to guard against the outbreak of fire
  • Provide fire safety measures and fire safety procedures
  • Make sure those measures and procedures are applied at all times
  • Protect people on the premises if a fire does break out

In a school that means

  • Clear escape routes and exits every day
  • Alarms and equipment tested and maintained
  • An evacuation plan that covers every student
  • Regular fire drills, recorded
